1. Acceptance of Terms

These Terms form a binding agreement between you and Lead Skills, LLC. By using the Site, submitting a form, or otherwise communicating with us through this Site, you represent that you have read, understood, and agreed to these Terms and to our Privacy Policy.

2. Our Role: Lead Generation Service

This Site is a lead-generation service that connects prospective borrowers with one or more participating hard money lenders who may be able to provide financing. We do not make loans, extend credit, take loan applications, issue loan commitments, set rates or terms, or make any credit decisions. All credit decisions, including loan approval, rates, terms, fees, and funding timelines, are the responsibility of the participating lender.

Submitting an inquiry does not guarantee that you will be matched with a lender or receive a loan offer. All loan programs are subject to borrower and property qualification by the participating lender. A current list of participating lenders is available upon request.

3. No Offer or Solicitation

Nothing on this Site constitutes an offer, solicitation, commitment, or advertisement to make a loan, to extend credit, or to provide any specific rate or term. Any specific loan terms you may receive will come from a participating lender and will be subject to that lender's own disclosures, agreements, and applicable law.

4. Eligibility

To use the Site, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding contracts
• Provide accurate, current, and complete information
• Use the Site only for lawful purposes

5. Your Consent to Be Contacted

When you check the consent box on our contact form and click Submit, you provide your prior express written consent for one or more participating lenders to contact you at the phone number and email address you provided, including by autodialer, prerecorded or artificial voice, SMS/text message, and email, regarding your financing inquiry. You understand your information will be shared with one or more participating lenders who may contact you.

Consent is not a condition of receiving any services or obtaining a loan. Message and data rates may apply. Message frequency varies.

You can opt out at any time by replying STOP to any text message, by calling 801-405-9262, or as described in our Privacy Policy.

6. Equal Opportunity

Hard Money Lenders of Salt Lake City connects borrowers with lenders who are Equal Opportunity Lenders. Participating lenders do not discriminate on the basis of race, color, religion, national origin, sex, familial status, disability, marital status, or age.

7. Acceptable Use

You agree not to:

• Submit false, misleading, or unauthorized information
• Use bots, scrapers, or other automated means to access the Site
• Attempt to gain unauthorized access to the Site, our systems, or other users' accounts
• Interfere with, disrupt, or overload the Site
• Transmit malware or use the Site to harass, abuse, or harm others
• Use the Site in violation of any applicable law

8. Intellectual Property

All content on this Site, including text, graphics, logos, images, and software, is owned by Lead Skills, LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. Except as permitted by these Terms, you may not reproduce, distribute, modify, or create derivative works without our prior written permission.

9. Third-Party Links and Services

The Site may link to or integrate with third-party websites or services, including participating lenders. We do not control, and are not responsible for, the content, policies, or practices of any third party. Your interactions with any third party are solely between you and that third party.

10. Disclaimers

THE SITE AND OUR SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT YOU WILL BE MATCHED WITH ANY LENDER OR RECEIVE ANY LOAN OFFER.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEAD SKILLS, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Indemnification

You agree to indemnify, defend, and hold harmless Lead Skills, LLC and our officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any right of another.

13. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws principles. Any action arising out of these Terms shall be brought exclusively in the state or federal courts located in Salt Lake County, Utah, and you consent to personal jurisdiction and venue there.

14. Changes to These Terms

We may update these Terms from time to time. Changes become effective when posted to the Site with a revised “Last Updated” date. Your continued use of the Site after we post changes means you accept the revised Terms.
